Booking Terms and Conditions (relates to trips, you’re probably more interested in these ones)

Live Adventure Booking Terms and Conditions and below.  For quick reference, here are answers to common questions:

  • Minimum age is 18.  
  • Lateness: Please be on time.  If you are late, we can’t wait for you out of respect for other participants.
  • Weather: Trips run in all weather unless we decide it would be unsafe, in which case we will inform you of an alternate, safer trip (no refunds) or if the trip must be cancelled (full refund provided).
  • Memberships: Memberships have a minimum 6 month term and will continue to be charged monthly.  After the 6 months, cancel at any time by giving us 7 days notice in writing.
  • Cancellations: If you cancel your participation in a trip, you will receive the following credit (12 month expiry):
    i) More than 30 days in advance, you get a full refund.
    ii) 7-30 days in advance, you get credit towards a future trip but no cash refund.
    iii) Less than 48 hours before the trip, or don’t show up for the trip, no credit or refund will be given.
  • Live Adventure has public liability insurance but we do not have personal accident insurance for you.  We recommend you obtain your own personal accident and/or ambulance cover.
  • Live Adventure activities are physically demanding and require at least a moderate level of fitness.  You must ensure you are in a suitable condition to undertake the trip. If in doubt, discuss with Live Adventure prior to booking your trip. We reserve the right to refuse your participation if you do not have adequate fitness to keep up with the group.
  • Contact us if you would like your situation to be considered on a case by case basis due to genuine hardship.

Booking Terms and Conditions

  • General
    1. You must fill in a registration form before your first trip which will be emailed to you.
    2. If you have any medical condition(s) that may make it dangerous for you to participate, or could be made worse by physical activity/exercise, you are unable to participate in trips unless you have medical clearance from your GP or appropriate allied health professional.
    3. Live Adventure reserves the right to change its services, schedules, memberships and pricing at any time, in which case, we will do our best to provide notification in advance.  Finish times are approximate and Live Adventure is not responsible for any loss, financial or otherwise if the trip does not finish on time.
    4. To take part in Live Adventure activities, you must register on our website, complete the Medical History form and agree to the terms and conditions.  You must disclose any known medical issues which may affect your ability to complete the trip, including injuries, fitness concerns, health conditions and allergies.
    5. Live Adventure activities are physically demanding and require at least a moderate level of fitness.  You must ensure you are in a suitable condition to undertake the trip. If in doubt, discuss with Live Adventure prior to booking your trip.  We reserve the right to refuse your participation if you do not have adequate fitness to keep up with the group.
    6. Live Adventure trips leave on time and if you have not arrived at the meeting point by the designated start time, we will not wait for you and you will not be offered a refund.  You may attempt to meet us during the trip, but Live Adventure is not responsible for organising these arrangements and you are responsible for any accidents or medical issues that arise as a result.
    7. The minimum age for the adventures is 18.
    8. You must book into a trip in advance using our online booking system. Please do not turn up to the trip if you are not booked in as we have a maximum number of participants and you may be refused participation.
    9. Live Adventure holds public liability insurance but does not hold any personal accident insurance, ambulance cover or travel insurance for participants. Live Adventure strongly suggests you arrange your own insurance to cover injury, illness, emergency rescue, loss/damage to personal items, cancellation.
    10. Some Live Adventure trips include rental of equipment (e.g. kayak, bicycle, canoe) from an external organisation.  The hire cost paid when you book the Live Adventure trip will be passed on to the rental activity provider. However, rental activities do not form part of this contract. You accept that any assistance given by Live Adventure in arranging rental activities does not render us liable for them in any way. The contract for that activity will be between you and the activity provider.
    11. You consent to Live Adventure using images and film of you taken during the trip for advertising and promotional purposes. If you do not want to have your photo taken or used on Facebook or other social media, please submit a written request to Live Adventure.
    12. Photographs, film or other comments published by you on any of Live Adventure’s forums, such as Facebook or our Website, may be used by Live Adventure without obtaining any further consent or payment.
    13. If you elect to leave a trip early for any reason, you will be responsible for your own travel costs and arrangements from that point and are responsible for any potential accidents or medical issues that could arise as a result.  
  • Cancellations by Live Adventure
    1. Live Adventure reserves the right to make changes to trips if necessary, including if conditions are deemed unsafe.  If changes are made, we will notify booked participants as soon as practically possible. No refund will be given if an alternate trip is offered.  If no alternative trip is offered, you will receive store credit to be used within 12 months or it will expire.
    2. In almost all cases, Live Adventure activities will proceed regardless of group size.  However, Live Adventure reserves the right to cancel a trip if minimum numbers are not met.
    3. In the case of an injury or emergency where the trip leader is required to stay with the affected participant for safety reasons, the remainder of the trip may be cancelled.  In this case, refunds may be offered on a case by case basis.
  • Cancellations by you

Membership cancellations:
Memberships have a 6 month minimum term so Live Adventure doesn’t normally offer refunds on them.  This is partly to know numbers to plan the best trips possible. It’s also to encourage you to make a commitment.  Like anything, when you start it may seem daunting but once it’s part of your routine, you’ll overcome the initial hurdles and you’ll be an adventurer before you know it!

If things don’t go to plan e.g. medical reasons or extenuating circumstances, email Live Adventure at  [email protected] with details (and a medical certificate if applicable) and a pro rata refund may be considered on a case by case basis.  Membership cancellations cannot be backdated.

Membership Suspensions:
You may apply in writing to Live Adventure to suspend your membership for a maximum of one month duration no more than once per 6 month period.  You will not receive any member benefits or discounts during this period. Suspensions will not be backdated. You will be given store credit based on the length of suspension (e.g. 15 day suspension in a 30 day month – you will receive credit for 50% of your monthly membership fee).

Trip Cancellations:
If you cancel your booking, somebody will miss out on having a good time because your spot was unavailable.   Live Adventure also has overheads to pay including how many instructors to bring based on the number of booked participants or rental fees.  This is why we don’t offer a full refund after booking. Contact Live Adventure if the reason for cancellation is genuine hardship.

You will receive the following credit towards future trips (must be used within 12 months or it will expire):
i) More than 30 days in advance, you get a full refund.
ii) 7-30 days in advance, you get credit towards a future trip but no cash refund.
iii) Less than 48 hours before the trip, or don’t show up for the trip, no credit or refund will be given.

 

  • Behaviour Policy
    1. The purpose of Live Adventure is to provide a fun and supportive environment for you to challenge yourself in nature.  Trips are run with a team atmosphere – we all encourage each other. Please respect and support other participants in the group.
    2. Live Adventure trip leaders have responsibility for group cohesion, safety and fun.  The decision of the trip leader is final. If you fail to comply with a decision made by a trip leader, or interfere with the well-being of the group, the trip leader may direct you to leave the trip, and you will not receive a refund.  You will be responsible for your own travel costs and arrangements from that point, and are responsible for any accidents or medical issues that could arise as a result. We may also refuse to allow you on future trips and we reserve the right to cancel your membership.
  • General Disclaimer

1. By participating in the activity, each participant acknowledges that participation in Live Adventure Activities involves considerable risk.  These risks could lead to serious injury, illness or death. These risks include but are not limited to: cuts and stings, sunburn, heat, cold and adverse weather conditions, dehydration, over-exertion and cardiovascular stress, rough terrain and obstacles, slippery and/or uneven surfaces, falling at edges of cliffs or elsewhere, adverse weather effects, plant and animal life, loss of personal equipment, swimming in patrolled and un-patrolled areas. In many cases the presence of Live Adventure staff is no guarantee of lessening of risks.  
2. There is also the risk that due to the remoteness of some of the locations, medical, evacuation or search services might be slow.  By booking an activity with Live Adventure, you agree that:
i) Any activity in which you participate is within your capabilities
ii) You have disclosed any pre-existing medical or other condition that may affect the risk that either you or any other person will suffer injury, loss or damage
iii) You are in general good health and have an appropriate level of fitness for the activities you choose to undertake with Live Adventure
iv) The business relies on the information provided by you and you state that all such information is accurate and complete.
v) You will make every effort to remain with the rest of the group during the activity
vi) It is prohibited to take alcohol or illegal drugs on any tours. Live Adventure may refuse to carry a person who is in possession of alcohol or under the influence of alcohol or any other illegal substance at any time during the tour.
vii) No smoking is permitted on any of Live Adventure’s activities in order to preserve the natural environment and reduce the risk of bushfires.
viii) You will accept the instructions of the leader of the activity
ix) You have considered the risks before choosing to book and still wish to participate in the activities of Live Adventure.
x) These documents record the entire agreement between you and Live Adventure in relation to the Activity and your participation in it.
xi) You have not relied upon any advice, representations or inducements by or on behalf of Live Adventure in deciding to participate in the Activity
3. By booking an activity with Live Adventure, you also agree to release Live Adventure Pty Ltd, its members, volunteers, and all other parties associated with organising the event from any responsibility or legal liability for death or personal injury associated with your presence at, and participation in, the activity. This release does not apply to significant personal injury caused by reckless conduct by Live Adventure.
4. As a member of Live Adventure, you agree to accept the inherent risks and dangers associated with any activity in which you participate with Live Adventure and the accompanying risk of injury, death or property loss or damage.

  • Limitation of liability
    1. Live Adventure’s total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.
    2. You expressly understand and agree that Live Adventure, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.
    3. I agree that if I suffer any injury or illness I agree that the Business may provide or arrange evacuation, first aid and medical treatment at my expense.
